If You Are Undocumented in the United States, Can You Migrate to Canada?

Many people living in the United States without legal status see Canada as a possible door to hope. However, that hope often fades when faced with the legal reality.

As a professional with more than 25 years of experience in Canadian immigration law, I have seen a great deal of false information circulating on social media — often shared by unlicensed “consultants” in the U.S. who portray Canada as an easy destination to access.
The truth is that Canadian immigration processes are complex and strictly regulated by law.

Here, I share what the law allows, what it does not allow, and what you must clearly understand if you are considering migrating to Canada from the United States.

Understanding Your Options

There is no universal answer to whether you can migrate to Canada.
Each person’s situation is unique, and your chances depend on several factors such as:

  • Your current immigration status in the United States.
  • Any criminal history or previous immigration processes.
  • Your migration goals and the type of application you wish to pursue in Canada.

Applying for Temporary Visas or Study/Work Permits

When applying for a temporary Canadian visa—whether to study, work, or visit—each category has its own process and requirements.
A fundamental condition is that the applicant must hold legal status in the country of residence.

If you are undocumented in the U.S., obtaining a temporary Canadian visa is often impossible. Some individuals choose to return voluntarily to their home country and apply from there, but this path carries risks: visa refusals, financial costs, waiting periods, and possible penalties upon return.

Applying for Permanent Residence

It is important to clarify that permanent residence cannot be purchased or obtained simply by desire or intent.
It is a legal status granted only by the Government of Canada to individuals who meet the eligibility requirements within one of over 100 immigration pathways.

The main programs—such as Express Entry, Provincial Nominee Programs (PNPs), and Pilot Programs—require strict compliance with:

  • Education level
  • Language proficiency (English or French)
  • Proven work experience
  • Clean criminal record
  • Medical examinations
  • Financial capacity

For someone outside Canada—especially without legal status in the U.S.—starting a permanent residence process is neither fast nor simple.
Having professional legal representation and a strategic plan aligned with Canadian law is essential to avoid costly mistakes.

Claiming Refugee Protection or Asylum in Canada

The Safe Third Country Agreement (STCA) between the United States and Canada prevents most individuals already in the U.S. (even without status) from requesting asylum directly at the Canadian border, unless they qualify under specific exceptions, such as:

  • Having a close family member in Canada.
  • Being an unaccompanied minor.
  • Exceptional cases involving safety or human rights concerns.

Additionally, the Government of Canada has introduced Bill C-2 (the Strong Borders Act), which strengthens border controls and limits unfounded asylum claims.

In simple terms: crossing the border or seeking refugee protection without meeting the legal criteria is not a viable option.
